PROP 65 NOTICES IN SELECT PACKAGES:
Anyone in California who orders a product with a Prop 65 warning on the PDP will be receive a California Prop 65 warning with their order. This is simply a “right to know” law, a common warning required by the state of California, that requires businesses to include a special warning on any products that contain certain levels of Proposition 65-listed chemicals, including naturally occurring or synthetic chemicals.

We will always work with the vendor to make sure our next order of the product will use materials that will pass Prop 65 requirements.

WHAT IS PROP 65?
California’s Proposition 65, also called the Safe Drinking Water and Toxic Enforcement Act, was enacted in 1986. As part of the law, California’s Office of Environmental Health Hazard Assessment (OEHHA) is required to publish a list of chemicals that are “known to the state of California to cause cancer or reproductive toxicity.” The list is updated at least once a year and now contains over 900 different chemicals. Many of the chemicals listed under Proposition 65 are additives or ingredients that may be found in common everyday products such as jewelry, household products, beauty products, food, alcoholic beverages, lead crystal, electric cords, cars, and furniture. If you’ve ever visited a Starbucks in California, you’ll even see a Prop 65 warning when you’re ready to order your drink of choice.

HOW DO I EXPLAIN THIS TO MY CUSTOMERS?
Here are some suggested words to say when talking to your customers:

“I completely understand your concerns around the Prop 65 notice on the ___. I can assure you this is a common warning required by the state of California and because Stella & Dot sells in all 50 US States, we are required to provide this warning before purchase for any items that may be shipped to California. Prop 65 warnings are really common in California, and are placed on common everyday products like nail polish, beverages, hair dye, household cleaners and paint. However, our production teams have assured us that all of our products fall within federally mandated safety levels for any toxic chemical, compound, or element. Let me know if you have any further concerns!”

We know you’re concerned about product safety and the safety of our customers is our utmost concern. Proposition 65 is a California “right to know” law that requires businesses to include a special warning on any products that contain certain levels of Proposition 65-listed chemicals, including naturally occurring or synthetic chemicals. That’s why you’ll see a Prop 65 warning on products that may be shipped to California.

HAVE WE CHANGED THE AESTHETICS OR PRODUCT DEVELOPMENT PROCESS?
No, there are no changes to the aesthetics of our products or the product development process. Stella & Dot is committed to making the highest quality products for you and your customers. This product triggered the Prop 65 warning requirement in the State of California, which is why we are providing this warning. Please rest assured that Stella & Dot products fall within federally mandated safety levels for any toxic chemical, compound, or element. We always have and always will conduct rigorous testing on our all of our products and will continue to adhere to all applicable state and federal laws, industry standards, codes, and regulations. For these reasons, our products can be sold with confidence.

WILL THERE BE MORE ITEMS CONTAINING THIS MESSAGE MOVING FORWARD?
At this time, our product roadmap does not anticipate any future products that would trigger a Prop 65 warning.

WHAT OTHER TYPES OF PRODUCTS MAY BE INCLUDED IN PROP 65?
Many of the chemicals listed under Proposition 65 are additives or ingredients found in common everyday products such as jewelry, beauty products, food, alcoholic beverages, lead crystal, electric cords, cars, and furniture.

WHAT DOES THE PROP 65 WARNING MEAN?
Prop 65 is a “right to know” law intended to help California residents make informed decisions before they make a purchase. OEHHA classifies the chemicals on the Prop 65 list as known to the State of California to cause either cancer, reproductive harm, or both, when humans are exposed to the chemicals above certain levels. For many chemicals, there is no consensus among scientists and experts as to whether the chemical in fact causes cancer or reproductive harm, meaning that not every chemical labeled as a possible carcinogen or reproductive toxicant has been conclusively proven to cause cancer or reproductive harm.

SHOULD I BE CONCERNED?
Please rest assured that Stella & Dot products fall within federally mandated safety levels for any toxic chemical, compound, or element. We conduct rigorous testing on our all of our products. Prop 65 is a “right to know” law that allows California consumers to decide for themselves whether to assume the chemical exposure risks of purchasing particular products. We adhere to applicable state and federal laws, industry standards, codes, and regulations. For these reasons, our products can be sold with confidence.
